Legal

Terms of Use

Effective

These terms are an agreement between you and NetsPositive, LLC (“NetsPositive”, “we” or “us”). They cover your use of NetsPositive, the website at netspositive.com, your account and any free trial or subscription you start.

You agree to them when you tick the box and choose “Agree and continue”, which we ask you to do after you first sign in and again when they change in a way that matters. We keep a record of the version you agreed to and when. If you use the site without an account, these terms apply to that use too. If you do not agree, please do not use NetsPositive.

Our Privacy Policy explains what we collect about you and how we use it.

In short

  • Estimates are for screening only. Verify taxes, insurance, HOA and rents before you offer.
  • Nothing on NetsPositive is financial, lending, legal, tax or investment advice.
  • Listing data and photos come from third parties and may be wrong or out of date.
  • Each metro is its own monthly subscription. It renews automatically every month until you cancel.
  • A free trial covers your first metro only. It's one per person and needs a card, and free access we give you uses it up. Cancel before it ends and you pay nothing.
  • Cancel anytime online in Account & billing, or by email. You keep access until the end of the month you've paid for.
  • One person per account. No scraping, no bots and no reselling data from the site.

What NetsPositive does

NetsPositive screens 1–4 unit homes listed for sale as long-term rentals on a 12-month lease. For each listing we estimate the rent and the monthly cost of owning the home with a loan at 20, 25 and 30% down: principal and interest, property tax, insurance and HOA, together called PITIA. When the estimated rent covers the whole PITIA, the listing nets positive.

NetsPositive is built for long-term rental investors. It does not cover short-term or seasonal rentals.

You see the deals for the metros on your account, apart from the free look before your first trial (see Free trial). Each metro is a monthly subscription you pay for, or free access we give you (see Your account and metros).

Who we are

NetsPositive, LLC runs NetsPositive from Nokomis, FL 34275, United States. To reach us, email hello@netspositive.com, or call (941) 307-3254 with questions. To cancel, see Cancelling.

Stripe processes our payments (see Automatic renewal).

How you agree to these terms

After you first sign in, we ask you to read these terms and our Privacy Policy, tick the box and choose “Agree and continue”. That includes accounts we set up for you. Until you have agreed, you can't use the deals or the rest of your account, except Account & billing, where you can always cancel. We record which version you agreed to and when, with the IP address and browser you used.

Starting a free trial or subscription asks for your agreement again: you tick a box agreeing to its automatic renewal, and Stripe's checkout asks you to accept these terms before you pay. We keep a record of what we showed you, what you ticked and when.

If these terms change in a way that matters, we ask you to agree to the new version (see Changes to these terms).

Agreements and notices by email

We give you agreements, notices, receipts and other messages electronically: by email to the address on your account, or on the site. You agree that they count as being in writing, and that ticking a box or clicking a button to agree counts as your signature.

To get them you need a device with a web browser and an email account you can read. Keep the address on your account working; to change it, email us. For a paper copy of anything we have sent you, email hello@netspositive.com. It's free.

You can withdraw this consent at any time by emailing us. NetsPositive works only online, so withdrawing it means closing your account, and we cancel your subscriptions first (see Ending your account).

Estimates are for screening only

Estimates are for screening only. Verify taxes, insurance, HOA and rents before you offer. In particular:

  • Rents are estimates. They are not appraisals, leases or promises of what a home will rent for, and the rent a home actually gets can be lower.
  • Property tax is estimated from state and county rules, and it may not match the bill a buyer receives.
  • Insurance is a county or state default, not a quote. Get a quote.
  • HOA dues can be missing from the listing data. When they are, we may count them as $0 or estimate them. Confirm them with the listing agent.
  • Loan terms are assumptions. The interest rate and other loan terms are settings we choose, and they can change. They are not a quote, a loan offer or a commitment to lend.
  • Homes are not inspected. Condition, needed repairs and whether a lender will finance the home are yours to check.

“Nets positive” means the estimated rent covers the estimated PITIA. Unless a page says otherwise, it leaves out vacancy, repairs, capital expenses and management, and it does not mean a property will make money.

Numbers change. Listings change, estimates are refreshed and we update our assumptions, so a figure you saw earlier may differ from the one you see now.

Not advice

NetsPositive gives you information, not advice. Nothing on the site or in our emails is financial, lending, legal, tax or investment advice, an appraisal, or a recommendation to buy, sell or finance any property.

NetsPositive does not offer, arrange or broker loans, and using it does not make us your agent, broker, lender or adviser. Before you make an offer, do your own checks and talk to qualified professionals, such as a lender, an insurance agent, a tax adviser and a home inspector.

Listing data and photos

Listing details, prices, statuses and photos come from third-party sources. They may be wrong, incomplete or out of date. A home shown as for sale may already be under contract, sold or withdrawn. When a listing leaves our sources, it stays on our deals list until a later full update of its market no longer finds it.

Listing photos and listing information belong to their owners, not to us.

We do not promise that NetsPositive covers every listing in a market or every part of a metro, or that it updates on a fixed schedule.

Your account and metros

You sign in with a one-time code we email you, or with your Google account. There is no password. Your account is created the first time you ask for a sign-in code, even if you never enter it, the first time you continue with Google, or when we set one up for you and email you an invitation.

  • You must be 18 or older to use NetsPositive, and able to make a binding contract.
  • Use an email address or Google account that is yours, and keep it secure: anyone who can get into it can sign in to NetsPositive as you.
  • Your account can hold several metros. Each one is a subscription you pay for, or free access we give you, and you see deals only for the metros on your account, apart from the free look before your first trial (see Free trial). You add metros yourself, from the metro list, and each metro you subscribe to has its own price, billing date and cancellation.
  • If you pay for a metro, use a card that is yours or that you are allowed to use.
  • Some features have limits, such as how many deals and searches you can save. We may change them.
  • You are responsible for what happens under your account, including the trials and subscriptions started from it.

Plans and prices

Each metro is its own subscription. It covers one metro for one person, and it is billed monthly, in advance, in US dollars. Before you start a trial or subscription, we show you its monthly price, when you will first be charged and how to cancel. Stripe's checkout shows the price again before you pay.

A new metro subscription costs $29 a month. Each subscription keeps the price it started at for as long as it stays active (see Price changes). Prices don't include tax (see Taxes).

Free trial

Only your first metro comes with a free look and a free trial; every metro you add after it is paid from the start. If your first metro is one we've already set up, you can browse its deals and open up to three properties before you start the free trial; no card is needed for that. After that, the metro's deals open once your trial starts. There's one free look per person.

Your first metro subscription can start with a free trial of 7 days. A trial works like this:

  • Your first metro only. A metro you add during your trial, or after you have had one, has no free trial. It opens when you subscribe, and its first charge comes at 12:00 pm Eastern time on the date we show you before you subscribe (that day or the next). A metro you've had free access to counts as your first, and free access uses up your free trial: if you've had free access, your subscriptions start without a free trial and without the free look.
  • One free trial per person. We check the account, the card and the email address. Addresses that reach the same inbox count as one: we ignore capital letters and a +tag, and in a Gmail address, dots too. If any of them has had a trial, or we can't check the card, we cancel the new trial right away, without charging you, and you can subscribe without one.
  • A card is required. Type in a credit or debit card at checkout: a trial can't start with a digital wallet such as Apple Pay, Google Pay or Link. Your bank may check the card when the trial starts. That check is not a charge.
  • It ends at the time we show you. A trial lasts at least 7 full days and ends at 12:00 pm Eastern time on the date we show you before you start it. The email confirming your trial repeats it, and we email you a reminder about 3 to 4 days before it ends.
  • Cancel during it and you pay nothing. If you don't cancel, your subscription carries on when the trial ends, unless we end the trial without a charge, as below. When it carries on, we charge the monthly price you were shown when you started it, on the day the trial ends and every month after that (see Automatic renewal).
  • A metro that isn't set up yet. If you start a trial for a metro we haven't set up yet, we add a day to it. While the metro still isn't ready, we push the trial's end out, by up to 14 extra days, and we email you when we extend it. If it still isn't ready when those extra days are used up, the trial ends at its end without any charge and doesn't become a paid subscription.
  • If we can't email you in time. If we can't send the email confirming your trial, or the reminder before it ends, in time, we move the trial's end out, within the same 14 extra days, and email you the new end. If they still haven't gone out when those days are used up, the trial ends at its end without any charge and doesn't become a paid subscription.
  • Ended without a charge. A trial we end without a charge in either of these ways can't be kept going with Keep my subscription, unless we ended it because its metro wasn't ready and the metro has been set up since. Once it ends, you can subscribe to that metro again, without a free trial, at the price at that time.

Automatic renewal

AUTOMATIC RENEWAL. Every metro subscription renews automatically each month until you cancel it. When you start a free trial or a subscription, you authorize us, through our payment processor Stripe, to charge your card the monthly price shown at checkout for that metro, plus any tax we have told you about in advance, on the first billing date shown at checkout (or the later one we email you, if we move your trial's end) and then on the same day of every month until you cancel. The first billing date is the day your free trial ends or, without a trial, the date we show you before you subscribe: 12:00 pm Eastern time that day or the next. There is no minimum term.

A price change applies to new subscriptions only: yours keeps the price it started at for as long as it stays active.

Prices are in US dollars. If your bank gives us a new number or expiry date for the card you enter at checkout, we charge the updated card. We email you at least 14 days before any change to these terms that affects you.

When a month is shorter than your billing date, we charge on its last day. Each metro has its own subscription, price and billing date, and before you add a metro we show you its price and first charge date for you to agree to. To stop the next charge, cancel before its billing date (see Cancelling).

We email you when each trial or subscription starts, with its terms and how to cancel, and about 3 to 4 days before a trial ends. We also email you after each charge, and once a year to remind you of each subscription. Stripe also emails you for us: receipts, a notice if a payment fails or your bank asks you to approve one, a reminder before your card expires and a reminder about your trial. Stripe's checkout, and the billing page where you can update your card and see invoices, are Stripe's own pages.

Cancelling

You can cancel a trial or subscription at any time, in either of these ways:

  • Online. Go to Account & billing → Cancel subscription (Cancel trial during a free trial). It takes one confirmation.
  • By email. Write to hello@netspositive.com from the address on your account, or reply to any of our billing emails (replies come to the same address), and say which metro to cancel. An emailed cancellation takes effect when it reaches us; if we charge you after that, we refund that charge in full.

The billing page Stripe hosts for us, which you open from Account & billing, is for your card and invoices, not for cancelling. Our phone number, (941) 307-3254, is for questions: we don't take cancellations by phone.

What happens then:

  • During a free trial, you aren't charged, and you keep the metro until the trial's end time.
  • After you have paid, we don't charge you again, and you keep the metro until the end of the month you have paid for.
  • Before a charge goes through, the subscription ends straight away and that charge isn't made: before the first charge of a subscription without a free trial, and in the hour or so after a trial ends or a month begins, while that month's charge is still on its way. Your access to that metro ends then.
  • If a payment is failing when you cancel, in any of these ways, the subscription ends straight away: we stop retrying the payment, and your access to that metro ends then.

We email you to confirm a cancellation. Until the end date you can change your mind with Keep my subscription in Account & billing, and we email you to confirm that too. A trial we end without a charge has its own rule (see Free trial). Stopping using NetsPositive doesn't cancel anything.

Refunds

When you cancel a subscription you have paid for, you keep access until the end of the month you paid for. We don't refund partial months unless the law requires it. We do refund:

  • a charge we made by mistake, such as a second subscription to a metro you already had;
  • any charge made after your cancellation reached us, online or by email;
  • the unused part of the month, if we stop covering a metro you pay for;
  • the unused part of the month, if we close your account when you haven't broken these terms.

To ask for a refund, email hello@netspositive.com. Refunds go back to the card you paid with, and your bank may take a few days to show them. Nothing here limits a refund the law gives you.

If a payment fails

If a charge doesn't go through, Stripe tries it again over about two weeks. We tell you on the site, and Stripe emails you for us, so you can update your card in Account & billing. If your bank asks you to approve a charge, Stripe emails you a link to do it.

While we retry, you keep a metro you have paid for before. If the charge that failed was your first one (when a free trial ended, or the first charge of a subscription without one), you can't see that metro's deals until a payment goes through. If no retry succeeds, the subscription is cancelled and we email you.

Price changes

A price change applies to new subscriptions only: yours keeps the price it started at for as long as it stays active.

We may change the price of new metro subscriptions at any time. A change never applies to a subscription you already have: it keeps the price it started at, every month, for as long as it stays active, including while a payment is being retried. A free trial you have started turns into a subscription at the price we showed you when you started it.

If a subscription is cancelled or ends and you subscribe to that metro again later, the new subscription costs the price at that time. So does each metro you add.

Taxes

Our prices don't include tax, and we don't collect sales tax or similar taxes today. If we have to start, we email you at least 14 and no more than 30 days before we do, and you can cancel before it applies. Checkout shows any tax before you pay.

Disputed charges

If you think we charged you wrongly, please email hello@netspositive.com first: we fix billing mistakes and refund charges made in error. If you dispute a charge with your bank instead, we give Stripe and your bank the records they ask for, such as what you signed up for, when you agreed to these terms and when you used NetsPositive. A dispute doesn't cancel a subscription; to stop future charges, cancel it. Nothing here limits your rights under the law.

Free access we give

Sometimes we give people free access to one or more metros: with an invitation, for example, or as one free metro per account while we aren't selling subscriptions.

  • Free access is for you alone. It has no cash value and can't be transferred.
  • It may have an end date, which we tell you when we give it. We email you at least 7 days before that date, or straight away if it is less than 7 days off, and again when it ends.
  • We may change or end free access at any time. If we end it early, we email you.
  • A free metro claimed while we weren't selling subscriptions gets an end date when we start selling them, and we email you about it.
  • Free access never turns into a paid subscription on its own. You are charged only if you choose to subscribe, at checkout.
  • Free access uses up your free trial, while it runs and after it ends: the metros you subscribe to start without a free trial and without the free look (see Free trial).
  • If you write or post about NetsPositive while you have free access, say that you got it free.

Metros we cover

You can choose any metro on our list, including one we don't cover yet. When you add one we don't cover yet, we set it up: that usually takes under an hour and can take up to a day, and its deals appear when it is ready.

A metro's deals come from the markets we cover in it, which may not be all of it: we may start with its main city, for example. The section on listing data applies to every metro.

If we stop covering a metro you pay for, we email you, cancel that subscription and refund the unused part of the month.

Acceptable use

Use NetsPositive to research properties for yourself. Do not:

  • Share your account or your sign-in codes. Each account, and each subscription, is for one person.
  • Scrape, crawl or bulk-download NetsPositive, or reach it with bots, scripts or other automated tools. Search engines may index our public pages as our robots.txt file allows.
  • Copy in bulk, resell, republish or redistribute listing data, photos, estimates or anything else from NetsPositive, or use them to build another product, service or database.
  • Get around sign-in, the bot check, the metros your account covers, payment, the one-free-trial-per-person rule (for example by opening more accounts or using more cards to get more trials) or any other limit.
  • Try to reach accounts, data or pages that are not yours, or probe, test, overload or disrupt the site.
  • Use NetsPositive in a way that breaks the law or infringes anyone else's rights.

Your content and ours

Your notes, saved deals and saved searches are yours. You let us store and use them to run NetsPositive for you, for example to show them back to you and to send the daily emails and texts you turn on. Other users cannot see them.

If a metro leaves your account, your saved deals, notes and searches stay. Saved deals in that metro are hidden and daily emails and texts leave it out until the metro is back on your account.

The NetsPositive name and logo, the site, and its software, design and text belong to us. You may use what you see on NetsPositive for your own research while you follow these terms.

Text messages

NetsPositive text alerts are optional, and only US mobile numbers can get them. If you add your number in Account & billing and agree to get texts, we text it a code to confirm it. After that, we text you an alert when a new listing nets positive in a saved search you turn texts on for (“Text me” on your Saved searches page). The people who run NetsPositive also get service alerts. Agreeing to texts isn't a condition of any purchase.

Message frequency varies. Message and data rates may apply. Each new listing is texted to you once at most, and several that come in together share one text. Alerts wait from 8 p.m. to 8 a.m. in your time zone, which your browser gives us when you turn texts on (you can update it in Account & billing); if we don't have it, in the time zone of a home the alert is about. They go out after that. Service alerts to the people who run NetsPositive keep these hours in their own time zone once they set it, and can come at any hour until they do, as can a test alert one of them sends.

Reply STOP to opt out; reply HELP for help. Turning texts off in Account & billing stops them too, and unticking “Text me” stops a search's texts. When you reply STOP, we text you once to confirm it, and then not again until you reply START: a STOP holds for the number, whichever account it is on. A STOP, CANCEL or other opt-out reply stops texts only: it never cancels a subscription (see Cancelling). For help, you can also email hello@netspositive.com.

Add only a number that is yours, or one you are allowed to use. Keep it current: if you change or give up your number, remove it in Account & billing first, so its next owner doesn't get your texts. A number gets texts for one account at a time: confirming it on another account stops its texts on yours.

Carriers are not liable for any delayed or undelivered messages. Texts can arrive late or not at all, so don't rely on them alone: your saved searches show every match.

Our Privacy Policy explains what we keep about your number and your texts.

Google Maps and other services

NetsPositive includes Google Maps features and content. Your use of Google Maps features and content is subject to the then-current versions of the Google Maps End User Additional Terms of Service and the Google Privacy Policy.

Signing in with Google uses Google's service, and our sign-in page uses a bot check from Cloudflare. Their own terms and privacy policies apply when you use them.

Payments go through Stripe. Its checkout and billing pages are Stripe's own, and Stripe's terms and the Stripe Privacy Policy apply when you use them.

Changes to NetsPositive

We may add, change or remove features, markets, data sources and assumptions, change limits, or stop offering all or part of NetsPositive at any time.

If we stop offering a metro you pay for, or NetsPositive as a whole, we cancel the subscriptions it affects and refund the unused part of the month.

Ending your account

You can stop using NetsPositive at any time, but stopping doesn't cancel a subscription; to stop its charges, cancel it (see Cancelling). To have your account deleted, email us, as our Privacy Policy explains.

Deleting your account cancels its trials and subscriptions straight away, so their access ends then, and we don't refund the rest of a month you have paid for unless the law requires it. To keep a metro until the end of that month, cancel it first and ask us to delete the account after that.

We may suspend or close your account, or limit what you can use, if you break these terms or misuse NetsPositive, or if we stop offering it. If we close your account when you haven't broken these terms, we refund the unused part of the month for each subscription.

The sections on estimates, advice, listing data, refunds, warranties, liability and governing law still apply after your account ends, and so does anything either of us owes the other.

No warranties

NetsPositive is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, about NetsPositive or anything on it. That includes any promise that estimates, listing data or photos are accurate, complete or current, that the site will be available, uninterrupted or free of errors, or that it is fit for a particular purpose.

You use NetsPositive, and rely on its numbers, at your own risk.

Limits on our liability

To the fullest extent the law allows, we and the people who run NetsPositive are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, investment losses or lost data, that come from your use of NetsPositive, from being unable to use it, or from relying on anything on it, even if we were told such losses were possible.

To the fullest extent the law allows, our total liability to you for all claims about NetsPositive is limited to the greater of what you paid us in the 12 months before the claim arose and $100.

Some places do not allow some of these limits. Where that is the case, they apply to you only as far as the law allows.

Governing law and disputes

If you have a problem with NetsPositive, please email hello@netspositive.com first. Most problems can be fixed that way.

The laws of Florida govern these terms and any dispute about NetsPositive, without regard to conflict-of-law rules. If you live somewhere else, you keep the protections of the law where you live that an agreement can't take away.

Any dispute we can't settle that way will be decided in the state and federal courts for Sarasota County, Florida, and you and we agree to go to court there.

Either of us may still bring an individual claim in small claims court where you live. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

Changes to these terms

We may update these terms. If a change is material, we email the address on your account at least 30 days before it takes effect, and until then we show the new version here, linked from the top of this page. When it takes effect, we ask you to agree to it the next time you use NetsPositive. Until you do, you can't use the deals, but you can still cancel in Account & billing. If you don't want the new version, cancel before it takes effect.

We never treat your continued use as agreeing to a material change, and a change never applies to a dispute that started before it took effect. A price change applies to new subscriptions only (see Price changes). Changes that don't affect your rights, such as clearer wording, apply when we post them.
